400k is the unused visas from both FB and EB. Don't know the breakup though.
The number 400,000 (total unused from family based and employment based) in Mrs. GILLIBRAND's website is an estimate as clearly mentioned in the website itself. During last year's recapture bill discussion season, the unused number many calculated and conlcuded was somewhere between 200K to 225K for employment based category.
The bill S.1085 doesn't speak of any specific number of visas to be recaptured. It says that, recapture all (unused visas from 1992 through 2007 + unused from previous fiscal year (2008)) and add it to the current fiscal year.
So, the total should be somewhere between 200K and 225K (or more).

I am sorry, not a computer guy, but can mass mailing for funding alerts from IV be possible to "loyal customers only"? I am not sure I am giving the right idea/ thought. But what I am thinking is lets say this Administrative cost re-imbursment works, can we send to selected 1000- 2000 non-core member like anzerraja or khodalmd (for example) and ask them to send money? Like how these sticky works...just a solid click and send money sticky. Or I dont know ask everyone...see how many people come in and divide the money...it can be 100 or more.

Let's pick up where we left off before this July 2 visa bulletin debacle (and the resulting struggle). Though the whole fiasco did get us our first taste of success, imho, and as such isn't insignificant by any measure.

Also how many new companies will they open. If everybody files a complaint every time someone is exploited the employer will have to either stop exploiting or stop doing business.
Just because your employer is willing to steal your money does not mean you let them do it. Just because a person is ready to make you a slave does not mean you should become a slave. Let them do what they want to do, we all should do what is right and what we have to do.

Dude, whatever it is, get out of that hole if you cant get GC filed.

I don't know why but we tend to be satisfied with lsmall benefits...
I agree with you "something (EAD and AP) is better than nothing"
But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..
What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.
I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.
After you apply for AP its only 1 year H1 increments.

We should definately ask these kind of questions. The credit is not mine completely. Another IV member asked this question at a previous debate and educated me about submitting questions to the california debate. This question did not get picked up at the previous debate. Let's work to get the question picked up this time
I guess we should use chances like these to get our agenda heard by the people and the govt. There are going to be atleast 3 more presidential debates we should try to get this question asked atleast in a couple of them. We can modify the question to make it more broad, but still keep the focus on legal immigration problems by highlighting it.

i got rfe for 140 asking for proof for ability to pay.one they have asked for is a tax return which i have got from the empliyer.the other is an audited financial statement for 2007..i understand that u need a cpa for it.anyone knows if just plain financial docs will do or do they have ot be audited.has anyone got it done?any idea about the costs?

Looks like this Sheila is in her new avatar, from 3 year degree people trying to make $$$ in others troubles! She threatened to sue IVians for exposing her tricks when she tried to advt her service in her posts, as friendly posts.
USCIS does not buy her evaluation anymore. Go to her and lose your valuable time and few thousand dollars in addition to your I-140.

Not sure about you, but a lot of the people enrolled into the doctorate program in the 2001-2004 time-frame out of necessity. They could not find a job after their masters and decided to go for the quals as a fallback. If you did actual research, you should have enough publications and acclaimed research to get you into EB1. If not, well then there's no need to cry in self pity here because you are getting exactly what you deserve.
If you read (and understand ofcourse), my gripe is not about my lack of ability or desire to file as an EB1, what i was pointing to was the general ridiculous notions being spread that
a) oh all EB2 India applicants are so "lucky" to have filed it in 2006 and getting approval now, so soon
b) EB3 India has been treated "unfairly" by USCIS
c) All of us "deserve" GC asap regardless of the numerical limitations on EB categories, oh this evil system.
Obsessive compulsive LUD checkers calling USCIS at the drop of a hat are a big part of the problem. If people could understand this simple fact that every minute that an IO spends telling some idiot if his name check is cleared or not could have been well spent in approving a GC for someone else. Every frivolous service request hurts the legitimate ones.
These forums were started with the best of intentions at heart and they do have useful information BUT now almost everyday, it is the same old story.....same question, same answer (ofcourse followed by the standard ..i am not a lawyer or go hire a lawyer and topped with oh, i contributed xx dollars to the "cause")
India has produced some of the finest minds in every era. Yet, these forums are more about green dots and red dots; he got approved...why didnt I?; and if someone dares to question, here come the personal attacks....

Now; the ac21 memo is a memo that uscis officers have to follow. However; the memo is not in accordanc with INA 245 or AC21.

ac21 says that a person can change jobs after 485 has been pending for more then 180 days.
The above two things are the law.
In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.

I don't think the only reason is "wife's cannot work".. The other reason for most is changing employers, and career growth while I-485 is in process.
