Aghast......:mad: Can this happen? I think they have to return the application filing fees. Has any one else heard about this.
USCIS cannot keep the filing fees if they return your application. They can only keep it if they do accept it and then deny/reject your application.

EB2I last year got 25K visas. This year, I am thinking we will get double that. Because 1. There are not many ROW labor approvals (Thanks to Atlanta process center) 2. Name check backlog cleared.

Seeing your postings gives me hope of getting GC this time.
Irritated with the lack of transparency and pathetic Customer service.
Created SR :- std reply blah blah.. under review..wait for 60 days.
Twice talked to IO :- First time response.. we are working on your case..
second response :- As per our info on my screen, it is not yet assigned to IO and neither pre-adjudicated. One person says one thing and another says another thing. I do not know what screen they are looking and how they are pulling info. What is the point of puting CSR if they have half baked info or worse no info on where the case is.
Have infopass appt late next week. Guess another garbage collecton day..:-)

It is absurd. You need people, so accept labor application and approve it. Then you authenticate the individual by approving I140. Then because this 'number' not being available you let the individual and his/her family in limbo state for 5-6 years.
The mistake is not on their part; it is on our part. We are so desperate for the GC.
I would blame all the dirty politicians back home who have not let the country flourish and thus forcing the so called 'smart' people to seek residence else where on earth.
It is too much for a social animal to go through in 'its' life cycle.
I am waiting for the day when we get the GC , we will tear it into pieces and throw in front of consulate.

We recently got the Atlas America Insurance with 0 deductible and got two visits done for my father(chest infection). Got antibiotics prescribed, blood test done, physical checkup done. Went very smooth, no payments at all.
Said that, someone who has tested a Emergency visit or a Specialist visit or an Intensive care visit should be able to give us a better idea of who fares better.
Till date, other then a PCPs visit, I have not heard any good reviews for any insurance cos(agents).
And then there are so many agents/sub-agents floating around, that even the genuine ones dont seem so genuine.
We should have a AM/S&P kinda rating system for Visitors insurance.

My PERM got approved on 07/23/2007 and my attorney is planning to file I-140 and I-485 concurrently by Aug 15, 2007.
I was offered a wage less than the proffered wage till pay period 07/15/2007 and my employer revised my wage to match the proffered wage from pay period 07/31/2007. Hence I would be able to submit 2 paystubs for payperiods 07/31/2007 and 08/15/2007 with I-140 application, which shows that I am currently getting paid the proffered wage.
Please let me know if these 2 paystubs alone are sufficient to demonstrate ability to pay.
We wouldn't be able to submit the employers Quarterly Wage reports with the revised wage as the current quarter ends only on Sep 07.
I understand that USCIS will issue a direct denial without an RFE if the employer is unable to prove atleast one of the following
(1) Net income - The initial evidence reflects that the petitioner�s net income is equal to or greater than the proffered wage
- (Supporting Evidence : Tax Returns).
(2) Net current assets - The initial evidence reflects that the petitioner�s net current assets are equal to or greater than the proffered wage.
- (Supporting Evidence : Audited Financial statement)
(3) Employment of the beneficiary - The record contains credible verifiable evidence that the petitioner not only is employing the beneficiary but also has paid or currently is paying the proffered wage.
- (Supporting Evidence : Annual/Quarterly Wage reports, paystubs)
Ours is a small company and doesn't have net income or net assets matching the proffered wage.

We already have chapters as the first and foremost source of valuable information. Once someone becomes involved and committed, they will signup for monthly contributions themselves. If we have enough of that to guarantee a decent source of recurring income like 20 40 k or whatevr, I dont see the need to deprive some depressed soul surfing the net looking for some reassuring information from having to goto bed in peace.

Did you keep new filing fee also? When I spoke to custumer service by 800 number call, she said you have to keep new check and original sealed medical along with duplicat filing.Wish you all the best!

Btw..I did "re-file" with completed medical yesterday. I am just hoping they accept my July 2 app. to avail, if any, advantages of RD.

1. with same employer, I actually got 3 years extension. (being 140 approved)
2. with diff. employer, would I get 3 years or just six months, or not at all?
With different employer, you can get 3 years as well, if the new employer has filed for a new PERM and you have received an approved I-140.
