Because consulting companies dont necessarily cancel pending labor applications when somebody quits. They let it run through the process and use that to substitute to a new employee. If they cant use it due to this new law, nobody else would jump in front of us in the queue.
Not sure whether this will help to move PDs faster, but will help a little. At this pace, if you can expect GC in 15 yrs, if Labor substitution is eliminated you might get ur GC in 13 yrs. :( (Saves you a Whopping 2 yrs of wait time)

I think the best way to approach this thing is to increase visibility of the "American competitiveness challenged" idea. Which is basically - globalization has made it easier for foreign students and high skilled professionals to go to other places, besides the US. This is a long term problem for American competitiveness and immigration laws must be adjusted to solve this� (you see where I am going with this).
Recently a group of influential CEOs pressed lawmakers and the Bush administration on the idea and subsequently several studies/ reports were released (I have attached one such report). Let�s build our case and momentum on this for next year (let�s face it: immigration reforms are dead for the year). I think the IV leadership has a huge opportunity in guiding/ co-ordinating such an effort.

There's a book put out by three 'scholars' from the Manhattan Institute with an innocuous title and everything else inside it anything but! The debate is being pushed to dangerous new grounds - while many openly say that all of America's immigration problems began in the 60's, code for colored people allowed in legally, one author said it was 'wrong' to link opening up immigration to all races (by abolishing hemispherical quota) and the civil-rights movement. Ofcourse he didn't say why. They always have to make a big point about Kennedy predicting that immigration wouldn't surge with the 60's act but why the 'surge' is a bad thing in itself is never fully explained - making use of hazy data and cause and effects that are highly diffuse to be really a true 'cause/effect' is the scholarly methodology used.And ofcourse he also argued that previous waves of immigration are different from the current ones but when the argument is brought up that immigrants eventually assimilate suddenly history is no guidance - in other words don’t look at history now! Given the complete lack of spine or commonsense of IV browsers, one can only hope this is just an ugly cycle that plays itself out and decent people recover their sensibility

We have told several times, that we dont have time to keep everyone in loop about everything we do in DC, including every time we meet some staffer or someone. Sorry, that's just how it is.
Last week, Aman was in DC on Thursday and Friday (Jan 25 and 26) and had meetings with 3 senate staffers who work on Immigration. Then he went to India, then he came back straight to DC monday morning and since yesterday, he has met with 2 more staffers, our lobbyists.
We are also trying to find out about the schedule A rumor and if its true, to have the recaptured visas go to all categories not just schedule A.
So there, you have your update? If you want to know more, then call us on the phone.
And this update is the kind of update we dont usually post on forums. This is mundane advocacy stuff. Find me one organization that gives hour by hour update of what they are doing.

I got soft LUD on 4/10 and a hard LUD on my wife's application on 4/13. My attorney recd the RFE today and informed that USCIS is requesting evidence of my marriage to be bonafide.
My attorney is asking for additional legal fees for replying to RFE. Gurus, do you think I should pay to the attorney or can I just reply to USCIS with evidence?

Suppose you work for Company A on H-1B. You get out of the U.S. and come back with AP. You become parolee at that time. File an H-1B extension with Employer A, get new I-94 that indicates your status is now H-1B.
6 months later, you get another job with Employer B. Since you already are on H-1B with Company A, you should be able to transfer your H-1B to Company B.

I agree house prices are falling across US, if one wants to make a quick buck, house may not be the best option. If the prices and interest rate swing, u will loose big time. It is a nice coffee talk however.
Take for example my friend pays 40 K mortgage per year, and the house price depreciated by 60 K here. he bought it in 2004. Now if he sells he makes 60 K less, + deposit, 80 K two years rent... so in effect, he cud have lived happily for 1200 rent per month, paying abt 30 K for two years and saved the moeny and headache and now he is not finding buyers - as there are lots of houses on sale. This is one of the best areas near San Jose.
So moral of the story is use commonsense. It is easy to give simple advices, if you do not weigh all factors age, job, how long u can repay etc, it will give u insight into affordability and the risks. We folks always look at an X or Y who made money, there are X-n people who also lost, which we tend to overlook for our convenience.

It took almost 4 1/2 years to get the labor certification and now its almost 17 months since my I-485 is pending approval. Took the path of writing to the FL, State Senator, Local Congressman and was fortunate to receive their response suggesting that its stuck in the namecheck stage and will have to wait for it to be completed. It has become a nightmare.... The only update in my case used to be whenever I initiate a service request. Now what is that which I can do to come out of this riddle....
Any suggestion in this regard is highly appreciated !!!!
Write to Mr. Bush (no kidding). They will send an inquiry to FBI and you will get something from FBI NNCP (name check division). If that does not help, file a lawsuit against USCIS/FBI. Or you can file a lawsuit first and then write a letter to save some time. The lawsuit will get things moving. The do-it-yourself guide is located here:

Assuming you decide to persue MBA from a good university instead of online. What kind of investment of time and money are you looking at? Is it really worth the investment when you are already in your 30's? Is is worth spending the time and money on a MBA? If you spend the same time/money on a business opportunity wouldn't that be better in the longer run? Is it practical to start a business when you are in the 7th/8th/9th year of H1b with no idea if/when you will get GC? Is it a safer bet to invest in education?
For PMP I think, you need to take some courses, I had taken some courses at Berkeley Online on project management, these courses count towards PMP.
They also have in class courses, if you are interested.
Better to do something than nothing.

Banking service is still way behind in comparison to US institutions. ICICI has to compete with nationalized banks in terms of competency and customer service so they surely do better but it is highly openly discriminatory depending on how valuable they think you are to them. Something that exists here but is very transparent. But I am sure ICICI has engaged in many questionable practices from marketing to collection, there have been some lawsuits as well against them.
