As I read the thread above on the perennial point of contention PD or RD or ND.
My question to the forum is how can TSC (My case was filed at TSC) sent an RFE if the case is not opened....I received an RFE in Nov of 2008...my 485 RD was July 23rd 2007 and ND was Sept 5 th 2007.
The RFE was responded to....now I was surely out of the ND window last year and technically an IO shouldn't have opened my file...but apparently he did...
Since I was contacting my local congressman and Senators...I got this feedback that my case is pre-adjudicated but waiting to have a visa number available....but I don't know who to trust...I am just not very hopeful and if 485 ND is the date they go by I have no chance and will miss this opportunity too.

No cap would be the best solution... but that is very tough to sell in Washington....That's why all this complications of asking to take dependents out of the cap and allowing overflow to go to China/India...
As I understand, IV already made these arguments to senators and even the senators who are sympathetic to immigration are not willing to remove the cap..The only thing they would accept is that the overflow would go to India/China/oversubscribed countries....I wonder if one of the core members would comment on this.....You do not need to name names....Just a request give a description of your interactions with law makers in this regard...That would put this issue to rest.....

We understand retrogression is due to non availability of visa but we will have some comfort factor, if we know un-used visa# that may move PD...

There is nothing surprising about sept VB. Retrogression is here to stay unless any bill is passed. Please take note of the action item we have posted if we wish to see a change instead of waiting for VB and hoping for change.

I am from AZ and Sherrif Joe is the best and the whole country should be proud of him.
He is doing the job which is supposed to be done by Federal govt and ICE, trying to take care of a border state county.

After 6 years, get nice job in India,own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. I think option 1 is best. We can request members to put the FOIA comment while paying. This is for IV leadership to track FOIA specific payments.
Option 2: Who ever is actually setting up the paypal account needs to be aware of tax issues. We don't want to pay 30% of our $5000 to UncleSam.

You know it might just mean that that the annual quota for I/C is over but the overflow is not a part of any quota. So EB 2 I/C should still see approvals...IMHO dont worry about the memo.
As per one of the patrons on another thread an IO showed him a memo recieved by USCIS suggesting that all Visa numbers for EB2 India/China were exhausted

US immigration policy is to get foreign people only when certain skills are not available. There are lot of laws are there to protect US jobs while hiring Foreign persons. And some more may come while increasing immigration. Some times it might not be enforced correctly. It is the mistake of US enforcement agencies and Companies but not the mistake of immigrants. Many immigrants are creating jobs here. Yes you have to complain to authorities if any one violated immigration laws. But there is no use of blaming all the immigrants. There is nothing wrong in increasing immigration with the protection of American jobs. If protection is not enough then you can ask congress to increase more protection of US jobs. But moderate increase of green card is needed. And IV goal will not increase immigration numbers and will not create unemployment in Americans because the persons will stay till getting green card. So it does not make any difference if they increase or not increase GC numbers. But it will make many persons life easier.

Good progress- the drought for contributions to iv is hopefully over,
but we are not there yet. We need EVERY active member to contribute at least $20, remember there are not that many active people here.
It's very encouraging to see that some of the contributions are from recent members. Maybe pappu can let us know at some point how much this campaign has collected so far.
If you are reading this and still watching from the sidelines: please join us. Contribute and add members. IF we are ALL involved, success will come. it's just a matter of time and patience.
