These are PDs in 2003 or before Apr 2004 cases. VB in Oct 2008 as well as in Oct NOv 2007 was at Apr 2004 thus these guys got approved even though the RDs were in late 2008. I am not sure what the processing times were in Oct NOv 2008 but these were certainly not in 2008 i.e. the processing time must have been in 2007.

Yes when you leave the country you are in status again! for i-485 AOS, USCIS will look at your status since your LAST entry into the country
Ok, so if I file the i-140/i-485 now and leave/re-enter the country with a new stamp. Now, if my I-140 is approved after that, and then my i-485 is looked at after that date, will I considered to be in status then, because by the time they are looking at the AOS application, I have already left and returned to the country??
Or should be in status the day the AOS petition is filed and even if i leave/re-enter the country after that, it does not matter?!

your immagination/calculation might be true.....so what?? Havnt we seen a lot of posting about what mischief is being done by a handful?? why do we spend our time on analysing that? IV shouldn't be a website where I log in in the morning and find what all mischief is happening or happened or will happen. There are mischief makers and let the law deal with them. we are a group of straightforward individuals who wish to concenterate on fighting the injustice of the extreme delays. If there was a mischief the USCIS is supposed to catch them and fix it. it is not allowed to delay yours/ mine just because a few others did something wrong. Please concentrate on today and tomorrow. Plan for a new line of action and we will join.

Hello Everybody,
This is my story,
1 - Came to US on B2 (visit visa) in October, 1999. My legal stay way valid till April, 2000
2- Found an employer and in March, 2000 filed for H1B/extension of stay. Lawyer at the time told me that since we filed H1 i don't need to file any other extension of stay
3- August, 2000 received approval notice of my H1 but approval notice mentioned start date of October, 2000 rather than March, 2000 as requested in the petition and approval notice did not have the I-94 card attached with it meaning they did not change my status. Appealed the decision and got some feedback from USCIS that they will look into this. Started working for the company in October, 2000. In January, 2001 Company received another notification from USCIS but I was never provided the copy so not sure what was the decision and was told all is fine but never provided the final approval notice. When i checked case status back in January 2001 it said case approved and approval notice sent. However when I check online case status now I see following,
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Cable sent to American Consulate or port of entry notifying them of approval.
On September 7, 2001, the appropriate American Consulate or port of entry was notified of the approval of this case. Please contact them directly if you need more information.
4 - In 2002 transferred my H1 to new company and got the approval with new I-94 card without any issues.
5- In 2004 transferred my H1 to another company without any issues and I�m with that company since then. They filed my labor, I-140 which has been approved and now ready to file I-485. Lawyer of this company wants to attach the approval notice of my first H1 from 2000 with I-94 card attached to it showing proof of my change of status which i don't have. I have approval notice without I-94 card from 2000.
6- I also left the country in 2006 and went to Canada for two weeks and then came back in the same month without any issues.
Current lawyer is fling I-485 without my first approval notice from 2000. Do you think this would cause issues or generate RFE for I-485? I heard that once you leave the country and re-enter legally all previous status issues if any are put to rest, I left the country in July 2006 and re-enter in the same month?
Please provide your input on my case...many thanks!!!

What is the need of any sublabor demand ( per direction of this thread?) if they just retain 140 date ? There would no need in first place for any one to use it.
The intent of a subst labor was to save the company time and money for obtaining another labor for the same position in case the original beneficiary drops out. Remember, labor was a company petition, not employee petition. The companies still would have wanted it even if it does not retain its original PD.
The basic thrust behind the idea of changing the rules of PD allocation for subst cases is to push forward PD to july 07 level. Most of the subst happened in that month. we are not asking subst labor folks to quit the queue, just asking them to move behind.
The intent of a subst labor was to save the company time and money for obtaining another labor for the same position in case the original beneficiary drops out. Remember, labor was a company petition, not employee petition. The companies still would have wanted it even if it does not retain its original PD.

I have been with the same employer since Jan 2004, and have every pay stub since then. However during some time in 2006, the company was in deep trouble, management takeover etc. and we were only paid for time spent on a major project (which was the cash cow). Because i was not directly involved in it, I was paid at about 50%, but every week, which lead my final W2 for 2006 to be around 76% of the total on the LCA. I looked at my paystubs and the total weeks at less than 100% is 5 months.
For 2004, 2005 and 2007 (on course) I am on course for my full salary. Also I got a bonus and stock options as the project took off and we are all in a better shape and my 2007 W2 should be higher.
Before 2004, I was a student on a F1 (MS degree) with one h1 in the bad days of 2002. However, my change of status was on the dot.. i.e. i got laid off on a friday and i filed my change of status to f1 the same day. My h1 visa was stamped in 2004 in India. My H1 was extended in early 2007
I am filing a self-sponsored I140. So, my question is:
1) Should I wait for 2008/whenever to file my i485 and hopefully show one year w2 and try to see if that goes through?
2) Try to convince my employer to pay me the back wages for 2006 (they may agree) in lieu of some future pay cut or paid out vacation or trade my stock options. File an amended return with a new 2006 W2 (what are the risks of an audit??)
3) Try to wait till 2008, stamp my visa extension and then file for i-485 showing only 2007 w2.
