We should also get a survey/feedback form from the IO for AOS interviews, POE etc so we can send the feedback to USCIS. The form should include date, time , IO name etc and survey questions...Only then USCIS can improve their service.

I joined a small company right after graduating from a university in the US with a masters degree. At the time of joining, I was told orally that my GC will be processed in a timely manner. Being naive and timid, I did not press the issue and months became years before the employer agreed to file my labor after work for the company for 5 years (1 year of OPT right after school + 4 years of MS). Although I work in high-tech and would have qualified for RIR, the company lawyer convinced me to apply using the traditional route promising the entire process would take two years. Once again, being naive I agreed. Now, I am on my 8th year with the same company with my labor stuck in BEC, and no relief in sight. I can look forward to years more in the same position and same company! Sadly, though I am highly respected senior member of the company (in terms of knowledge and time with the company), people who joined after me and were trained by me, have gone on to Managerial positions, while I can only sit and watch.
I do not blame anyone or anything for my predicament, except my naivety. At least, I am glad for sources of information such as immigrationvoice, immigrationportal and immigration-law that have helped me immensely with my education on all matters immigration. Now, I feel I know more than my lawyer and cannot be convinced to take foolish decisions. So, it gladdens my heart to see that we in immigrationvoice seem to be having some impact on the lawmakers as it feels like I finally have control over changing my status quo.

This does not mean we will not be seeing any approvals now. USICS might have assigned the visa numbers to lot of pending EB2 I-485 applications. They will be adjudicating those cases in few days. So folks keep the faith , keep bugging USCIS (call them day and night) and check immigrationvoice.org every 2 minutes and also don't forget to check your emails and uscis.gov website for CRIS updates every minute :eek:

I have a nine month old and I can understand your feelings. I hired a nanny through sulekha but did a lot of reference checking and tried her when my parents were around here in US and they monitored her carefully and then gave us the green signal to keep her before they left.
So not all nannies are like that. There are good nannies too. I pay a lot of money a lot more compared to what thunderbolt quoted ONLY because we found her to be nice and caring. She gets calls from her earlier employers who say their kids want to speak with nanny and say hello.
It is just your bad luck. Nannycams are very useful and plan to get one for myself just for my satisfaction even though we are happy with our nanny.
Like someone suggested - daycare would be a good option and I even thought about it but a 8 month old kid may catch alleriges easily and thats why I backed off too.
Now about legal recourse - the best thing is to get out of any kind of mess. You were aware that you must not hire a nanny illegally and now you pay the price. No problem. Just say good bye to her and be careful next time

A law suit may be our last resort, however I am not convinced that the time to use the option has come. However, its not wise to overlook an option. I would say lets start compiling a list of facts which potentially can be used to file a lawsuite. Please be innovative and think hard what causes you to file a lwsuit. Lets evaluate all such stances, and get them verified by an attorney.

Ok, so if I file the i-140/i-485 now and leave the country with a new stamp.
what do you mean by new stamp ? once you apply for I-485 , you need to wait until you get your I-485 reciept# to leave country.
Now, if my I-140 is approved after that, and then my i-485 is looked at after that date, will I considered to be in status then, because when they are looking at the AOS application, I have already left and returned to the country??
I guess you have to get new I-94 and submit that new I-94 to USCIS.
Or should be in status the day the AOS petition is filed and even if i leave/re-enter the country after that, it does not matter?!

Let's assume B entered into US on Jan 1st 2004 with Visa stamping Valid till June 2006.
B doesn't have payslips for period of 185 days(aggregate) in his whole stay in US , rest of the time he maintains legal status , but he never travels outside US and applies for his 485 in March 2006.
In this case B is under risk of illegal status for more than 180 days , as he never travelled outside US.
OK agreed , when it's a law we should abide by them.But what are the other options available for B? He can't be covered under 245(K) so this option is ruled out.He needs to forget about GC? Will it be helpful if he contacts good lawyer any hope? Or just rely on luck?

You are allowed to express your views without fear of persecution, but the IV forum is maintained by IV admins and they have the right to delete whatever they want.
Free speech means you can go start your own: oppose-interfile.org and no one will stop you. It does not mean that you can post whatever you want on any forum and people must leave it as-is.

i concur with the aspect of filling a lawsuit, as it will create more visibility and put more pressure on congress. As it is congress is under the gun for failing to act on a lot of bills. Even though if it does not create instant results, it will definitely lead to some type of change in coming months. I am sure if we all pitch in 50$ each, we can accumulate good amount of money. Also we can use Murthy Law firm to file a lawsuit. Lets not forget the amount of visibility Murthy law firm is getting from IV. If there is a law suite filed through them, then they also get to share the limelight.
The point here is, we can get a discounted price on the service, also Murthy law firm is aware of our situation. Administrator what do you think?
All EB3 guys, stop complaining about EB2-EB3, it is about EB community. IF EB2 get some direct benefit, then it will be rolled down to EB3 as well. Please let us not discuss issues which separate us. Right now we should focus on unity and creating a mass number of high skilled workers who can SHOW up on rally's.

Sorry but I don't agree with your point that if EB2 benefits today EB3 would benefit tomorrow. It looks plain and simple but it's not so in reality. Unless all EB2 categories become current and EB3 ROW get the overflow and become current, EB3 I (or China or Mexico) is not going to be benefitted from EB2 getting a VISA! You are basically saying to EB3 filers to wait for another 10 years so that the EB2 queue may reduce so that EB3 queue would start moving. That's not a practical solution.
I think once there is an overflow (from EB1), then it should:
1. go to the category that's retrogressed more or
2. split the overflow among retrogressed categories and
3. go to EB2 if both EB2 and EB3 have the same cut off date.
Does US need more EB2 (than EB3) or need them sooner (than EB3)? If they need more EB2, then EB2 can get more numbers (but the restriction should happen at H1/L1 level). If they need them sooner, then they can be on a fast track. But by approving a EB3 or EB2 I140, the Govt. is saying that they need that particular applicant. A vast difference between these two categories at the last queue (485) does not make sense.
It is insane to ask a EB3 I 2001 filer to wait forever just because he filed under EB3 and grant a VISA to EB2 2004 filer! It is not different from granting a VISA to a EB3 2007 ROW filer and making EB3 I 2001 wait. EB2 is taking all the overflow which, in my view, is not correct. EB2 is benefitting at the cost of EB3 I (China and Mexico). EB3 ROW is benefitting at the cost of EB3 I (China and Mexico). Just my opinion.

If it were for some of the antiimmigrant folks, my friend you (sugaur) wouldn't be here a day longer. you would be "out" in a wink from this country. so dont consider yourself too supportive of anti-immigration. Even citizens are favoring resolving the ilegal immigration crisis by granting some legality to those who are here ilegally. Dont support ilegal immigration but atleast dont bash those who show support to resolving this crisis. you and me are mere temporary visitors here. please remember that your country is not this. you are here seeking prosperity and so are they. this country has a way of dealing with them and us and neither has been satisfactory so far.
