You joined just one month ago and started accusing IV because they did not reply to your PM. We get several PMs, emails, phone calls everyday. We try to attend as many as possible. However we also have our jobs and life. Not every IV core member comes to the forum to post messages. There are several things we do for this cause that is not forum management work.
If we had an office with a customer service department, we could answer everyone. If people want good customer service from IV, are they willing to provide help through their spouse who does not work and stay at home? In the last 2.5 we have posted several times, but only a handful of members offered help through their spouses to volunteer for IV. After initial start, almost all disappeared within 15 days because there was no money and appreciation by members in this volunteer effort. They preferred to find own jobs and make money. So tell me if you are willing to help out in managing our customer service 24/7?
This is for everyone:
Stop accusing IV if your greencard is not coming soon enough. As Admin2 said, we try to reply to people and help them. Put yourself in our shoes and try to do what we are trying to do. Take out that many number of hours everyday for IV as we do. Go on your own expense to DC and meet lawmakers. Get threats from anti-immigrants and still continue to work on this effort without fear.
There is a thread for high five campaign. How many of us have really contributed a mere 5 dollar for it? The community of more than 30 thousand has failed to raise even 5K in more than 2 months and yet we want to see results. 5K is not even enough to file one greencard case and you want to lobby with it and fight with anti-immigrants who spend millions opposing us? Where is IV membership now when we need them? Is the IV membership ready to take the blame for its failure?
Today everyone is talking about sending clocks, letters or even has the courage to send emails to USCIS. 2.5 years ago people were scared to do any of this. Nobody was talking about employer problems or lawyer problems and willing to name them on forums. There was no action item. There was no awareness. But today we have changed all that. This is IV's biggest achievement.
So before you start pointing fingers at IV, pose a question to yourself. Have you done enough for this cause? We need threads to translate into action and results. Your contribution for IV should not be how many threads and posts you have created but what you have done for the community.
As we have always said, join your state chapters and if your chapter is not active, make it active. Be a leader. Use your energy to lead the effort and travel to DC and meet lawmaker offices. Meet lawmakers in your area. Make phone calls, write letters. But don't just create threads with ideas. We need people to work on those ideas.
Remember each one of us is responsible for IV's success and failure and IV is everyone.

Your posts are getting very irritating with this blind belief in this "Unitednations" fellow. Why do you believe in him so much? What has he done?
People in this forum are about 1.5 years behind in the understanding of retrogression (all of these issues have been dissected, diseminated, corroborated, etc.); how the law works; what visa bulletin said in November 2005. dissecting numbers, etc.
There is much deeper understanding of this on immigration.com since it has been going on for a while. Chandu is a member there and has been following it and participating on it.
I would think something as important as this; one would research it to death and get all possible statistics on it. All these things have already been laid out in great detail very long ago.
Don't know why you are irritated??? Maybe you should research it with the law and the various statistics by uscis, dol, dos and see what conclusions you can come up with.

For the love of God, there are things that you go and post on the Internet to get people's opinion and there are things that you don't! Unlike some others here, I don't want to too judgmental (something we, as a people, excel at) as everyones situation and experiences in life are different. But here is what you need to do ASAP. I mean right now and today: get out of your office if you have to but go out and do it right now.
1. Go talk to an immigrant attorney immediately. You need to assess your liabilities in this situation. If you are at fault, you need to improvise a defense strategy and IMMIGRATION VOICE IS NOT THE FORUM FOR THIS!!!!
2. Immediately talk to a criminal defense attorney. The fact that you know about child abuse and have not reported it yet is a SERIOUS, SERIOUS, SERIOUS,....., SERIOUS issue. It varies from state to state but not reporting child abuse may or may not be a crime IF you an establish that you took immediate steps to protect the child from the abuser. Again, this depends on how zealous the prosecutor and child protection services are.
Depending on how your attorney advises you, proceed to inform the authorities.
Trust me man, I have done projects with state and county level agencies and this is serious stuff and you need to act now to get in the driving seat. Inaction is NOT an option.
Best of luck and may God protect every child out there.

Just today I was reading on the ac21 thread, how you lamented that we as a community dont stand up for injustice and how some folks are worried that writing AC21 letter may mess up their situation somehow ......
And right now , you are suggesting that the best thing is to get out of any kind of mess. So the person knew he was doing something illegal and his 8 month old kid was beaten up and you feel he paid the price and now No Problem and he should move on ???????????

You have some people advertising that they provide nannies for elderly care, child care, they provide food on daily basis and also provide cooks for occasions, services ranging from janitor work, to helping with groceries and all sorts of stuff.
This industry is big - very very big. Some agencies did tell us they have nannies on j1 visa.
We on this forum who are very vocal are the most innocent folks in the world when it comes to this kind of stuff and we have a straight tangential approach of punish someone for beating the kid.
Well - lets use our brains instead. Believe me - our community does not have any sympathy, because we are not united.
People can come on this forum and give advises - but the person who implements it must know what he can expect and that's why he posted here. Our friend is on h1b and maybe having his 485 pending and he must have careful thoughts before he leaps into something.
What is the guarantee that a certified nanny wont ill treat the child. I have heard that nannies need not beat the child but do give mild sedation to babies in their milk so that the nanny can be in peace. If a nanny is doing that do you think she will be caught on tape?
There are tons of things nannies do and you may never be aware of it or may not be caught on video tape.

Thanks man. My decision was mainly based on the waiting period. Within 4-5 years I can get ultimate post based on my experiance at india but here I have to be in same role.
Also I am trying to start my own IT training firm there so with gods on my side in 4-5 years that company can grow to a mid size firm.

This is a totally wrong message someone out there put out to make people nervous. Application support centers do no have IO's. The only IO's you will meet would be at a different USCIS facility where you take appointment and stand before the counter and ask the questions.
There will be no reason why someone would meet a IO at the fingerprinting place which generally have technicians and security to monitor the process. You sit in a waiting room alongwith 100 other people, then once your name is called, you do the fingerprinting and get out of the door.
There is no time to mingle with IOs nor there will be IOs(friendly or not) who would be willing to disclose any information to you.
Some people online gloat at having pleasure to spread disinformation. this seems to be the case...

But please try to understand that things are different here --- by definition, we are immigrants, our numbers are limited in this country.
Okay. Its obvious that we need more participation from members for higher rate of success for IV campaigns.
Simply put, groups working in isolated corners of the country are having no effect on the politicians, because each area has only a few people and the politicians are not seeing the combined effect.
"Grass root efforts" may sound very trendy, but are actually leading us no where............yes we need it......but at the same time IV has to have a strong leadership who can show their strenght by doing phone / lettere campaigns.
Actually I disagree with you on two fronts. Even with low member participation, whatever success IV had is to a large measure due to the member participation. Second point is your post seem to suggest, I might have misread your statement, that just the IV leadership alone can make the phone/letter campaign a success. How? I am not privy to IV core information but I would doubt that just the IV core calling and writing letters would persuade the folks in DC to change their position.
My take is that the IV core can help come up with focused action items, and its by increasing grass roots effort that we can achieve the IV goals. IV core can also help with the lobbying activity, which again needs funds from the members. Increasing member participation in IV is the difficult part. Talk is easy.

From february 2004 (expiry date of i-94 card) until april 1994 it looks like you accrued unlawful presence. The unlawful presence stopped when you filed the 485.
The unlawful presence was wiped out when you left and re-entered usa (the 3 year bar didn't kick in because the unlawful presence was less then 180 days).
You will be fine.
Just be truthful that you filed 485 before; you had divorce and all the employers that you worked with. Only thing they can get you on is if you try to embelish or hide things even though they were forgiven when you left and re-entered.

As I read the thread above on the perennial point of contention PD or RD or ND.
My question to the forum is how can TSC (My case was filed at TSC) sent an RFE if the case is not opened....I received an RFE in Nov of 2008...my 485 RD was July 23rd 2007 and ND was Sept 5 th 2007.
The RFE was responded to....now I was surely out of the ND window last year and technically an IO shouldn't have opened my file...but apparently he did...
Since I was contacting my local congressman and Senators...I got this feedback that my case is pre-adjudicated but waiting to have a visa number available....but I don't know who to trust...I am just not very hopeful and if 485 ND is the date they go by I have no chance and will miss this opportunity too.

Published dates are approximate dates for a ball park idea on where cases are for minimizing phone calls. If published date is Sep 8, 2007. It could have a very wide window of reality between (i) someone has looked at least one case of this date, or (ii) All cases upto this date have been seen. Further, your contacting congressman and Senators might have triggered action on your case. In a paper dealing world, there are no precise answers. Published dates are based on manual feedback by dozens of IO's at each center.

The RFE was responded to....now I was surely out of the ND window last year and technically an IO shouldn't have opened my file...but apparently he did...
Since I was contacting my local congressman and Senators...I got this feedback that my case is pre-adjudicated but waiting to have a visa number available....but I don't know who to trust...I am just not very hopeful and if 485 ND is the date they go by I have no chance and will miss this opportunity too.

Published dates are approximate dates for a ball park idea on where cases are for minimizing phone calls. If published date is Sep 8, 2007. It could have a very wide window of reality between (i) someone has looked at least one case of this date, or (ii) All cases upto this date have been seen. Further, your contacting congressman and Senators might have triggered action on your case. In a paper dealing world, there are no precise answers. Published dates are based on manual feedback by dozens of IO's at each center.

abolish per country limits on EB visas will back fire us because of diversity issue. We should propose some thing where there is no controversy to reject and that's is recapture 200K visas and EAD/APO for 3 years

Hi Guys
I would like to point out a few things about the recent Lobby day we from IV did on June 6th and 7th in Washington DC.
I am a proud participant and I am glad I did take part in it. This was my first time and I am ready to this again when needed. Initially I was skeptical about this drive like a lot of you . But after I saw the commitment and dedication of our senior members , I am encouraged and I am glad I went there to DC and I was surprised how positive was the response I got from the offices of senators and congressmen and congresswomen. There were a lot of IV members who traveled from all across the country although there were a few states from where members could not make it to DC. Thanks to all of those who attended this event and those who attended know how much positive feeling we had on those 3 days.
In my opinion we were successful in bringing the attention of various congressmen/congresswomen and senators to the issue of employment based green card backlogs. A lot of the senators offices were already aware of what IV is doing and in some cases when we said we are from IV, They started telling why we were there and they were very supportive of our cause.
Some of them had no idea what we were talking about. They think that there is no such thing as backlog in green cards for high skilled immigrants from some countries like India and china and Philippines etc.. We had to educate them and explain the entire green card process steps to their legal aides but towards the end they understood our issue and were supportive of our cause.
Actually a lot of the staffers of senators and congressmen attended the Reception on capital hill on Tuesday. That also underscores the support we have there. To translate the support into more concrete legislative support in our favor, We need to organize more and increase number of members attending these events in future to have a more solid impact on them.
I want to bring up one point very clearly. Guys there is no one in Washington DC offices talking about the difficulties we are facing other than IV organization members . We need to lobby the lawmakers much much before any legislation is drafted and taken up for debate in congress. If we think we will rise up and make some noise when the bill is tabled, we are wrong. By then we will be very very late in the game. The deals would have already be done in congress and our issues will not be addressed at all. ( that is just how business is done in Washington . If you snooze you loose) We need to rise up and take a more active role in IV by
1. Contacting senators and congressmen in our districts and explain to them the issues we are facing , IV Can help you by providing the documentation required and any other help needed in talking to the representatives. ( you will be surprised by their support and positive response to our issues when you meet them )
2. Register and take part in the IV state chapters meetings and discussions
3. Donate what ever we can ( 10 , 20 , 30$ etc..) to our cause in IV . If we can not help ourselves, no one can help us .(keep in mind in DC We would need money to take up any advocacy efforts ).
4. Participate in the lobby drives and other such events to raise awareness about our problems. Numbers really matter in DC . just posting the issues on forums will not help us although it may serve as a consolation by venting out on forums . this will not take us anywhere
Guys please talk to your friends who are in the limbo in EB GC process and get them to actively be involved for our cause. We all will be benefited by the results from the efforts we put in. We all have day jobs at the same time we need to sacrifice some time and resources to the larger cause.
Hope I have inspired my fellow members who are sitting on fence to actively get involved in IV and support our cause.
