I am not sure if you are being facetious but I think that is a great idea! :)
No, I'm not being facetious :)

There is always a chance that a well publicized (we are working on that part!) rally might attract opposition to the rally.

I wholeheartedly think that this gesture would be seen as fairly "american" and could defuse tension if it arises. Plus it would link back nicely to the flower campaign as well, and the eventual destination of the bouquets sent.

Political stance on wars aside, I don't think there are many people who don't support the lives on the line.

These things are not going to fly. Just go back and work. When time comes GC will come to your mail box, until then keep extending your status, work and enjoy the life. Why do you think too much and lose mental balance.

My dad, had to use the insurane, unfortunately. All the hospitals, docs offices billed the insurance company directly. I had to pay only for the prescription medicine after he was discharged, as pharmacies bill online, and they do not have online setup with indian companies's adjusters here.

Icici lombard paid as per the coverage, it took a while, but was was mostly due to my dad's doctor back in india took long time to respond to their questions. I am not sure on the 70+ factor, as my dad was 61 that time.

    Hope this helps.
Is there website to buy insurance from Indian companies? Do they cover emergency treatment for 70+ years old? I have heard it is very difficult to have claim processed through them. Do you have any personal experience?

This is a developing story. I am sure there are lots of IV members in H1 and getting/going to be affected. one of the option I am trying to explore is to take the USCIS and CBP to the court. They do not have the authority to decide the employer-employee relationship.

    First they came for the communists, and I did not speak outbecause I was not a communist;
    Then they came for the trade unionists, and I did not speak outbecause I was not a trade unionist;
    Then they came for the Jews, and I did not speak outbecause I was not a Jew;
Then they came for meand there was no one left to speak out."

The Insightful Immigration Blog Commentaries on Immigration Policy, Cases and Trends: NEW USCIS MEMO ON EMPLOYER-EMPLOYEE RELATIONSHIP FOR H-1B PETITIONS: IS IT A WAY TO KEEP CERTAIN WORKERS OUT? (http://cyrusmehta.blogspot.com/2010/01/new-uscis-memo-on-employer-employee.html)

    http://www.uscis.gov/USCIS/Laws/Memoranda/2010/H1B%20Employer-Employee%20Memo010810.pdf

Here I want to know how many IV members are in H1B and going to suck into this and how many are ready for the fight. In terms of money and time. Remember, you may not be travelling out of the country anytime soon. But when you are filing for I-485, USCIS can deny because you are not in status at the time of filing. Because throughout the H1B period you need to maintain the employee-employer relationship as per this memo. So no one is safe.

So its time to decide our future and life. If you are complacent and soon you will pay the price. Act before its too late.

Lets take the bull by its horn. If you vote, post your details in this thread. otherwise there no use of voting.

Absolutely not. AC21 only removs the per-country limit in any calendar quarter in which overall applicant demand is less than the total of available numbers. In the present calendar year, the overall demand is defenitely more than the total of available number and AC21 priviledges would not apply.

DOS would clearly violate the 7 percent limit if excess EB2 ROW numbers flow to EB2 china/india. Don't want to get into an argument here, so I will leave it at this. Each person is entitled to his/her interpretation just as DOS has its own. Peace.

I agree with you, if you could able to show the difference between allocation of unused visas pre-AC21 priod and after AC21 period. Lets say 10000 unused visas availbe in EB2. Please tell me how it will be handled if it is in 1999 and 2006. Please read section 202 of INA and post here. I am stopping here. Bye.

There is nothing in it for us. In-fact, if this bill passes, they are goin got apply the unused visa numbers towards FB, and we will lose any chance of re-capture, for-ever.
I think, we have a lost cause. The sooner we accept this, the better. We simply do not have the funds, commitment and political support that the illegals enjoy. We all know where the maximum nubver of FB immigrants are from, and they represent a big block of votes, since most of them happen to have the herd mentality, due to lack of education.

We, on the other hand, are educated, well read, tax paying people, who actually think about issues and merits of a person, hence no use to politicians.

Please, could you try and be a bit more positive. 400K illegal to legal or otherwise is a 400K vote if granted residency. Meaning you - a legal, educated and GDP contributor shall have more a chance to those less educated with menial jobs and no real standing on ways of life in this country or a positive contribution to true development. Being positive is half the battle won.

Apply for I-485, if you find the "right" partner before approval get married asap. If not, find the "right" partner in US and get married. Finding the right partner is equally important as getting a GC. Dont rush it guys!:D

I did not use to word wrong, so dont try to setup strawman arguments. I used the word unfair. And using the reverse argument that you use. It ain't "right" just become you support it.

And yes, it is unfair, because it is unfair for all those promised the current system, not because I think it is unfair.

Well, I could read out for you what you wrote. You wrote that - "I am EB3-India, yet I dont support the removal of per country limits, as there is a reason for the diversity rule, Indians and Chinese are currently on the wrong side of the equation so it seems "fair" to remove the quota."

    Does that ring any bell?

And, if everybody was promised the current system, then there should never be any change, ever, because whenever you make any change, it will be unfair to the people who are waiting at that time, right? Even the increase in numbers or recapture is unfair because when we applied, we did not know if recapture will happen, right? So why change. There should be absolutely no change because my galactically stupid friend sc3 thinks he was "promised" something. Open your eye, there was no promise made to you or to anybody else, the system has evolved and will continue to evolve while we continue to wait for approval. Its ok if you don't believe in evolution theory, maybe that evolution thing is also "unfair" and "wrong". You see as we all continue to learn, we all continue to improve ourselves and our surroundings from that process of learning, but there are some who do not want to improve anything, inspite of learning. Here you can argue that learning process is at different level/speed for different people. So that would be quite understandable.... you know what I mean

I dont think any of your postings are less stimulating but I guess there is no big impact on these free lunchers.
Very true. Here is an example. Item 3 in following post is to decide the importance of contributing $20/month to the member.

Stephen Covey Quotes to help members focus on their responsibilities.

Our character is basically a composite of our habits. Because they are consistent, often unconcious patterns, they constantly, daily, express our character.
If we keep doing what we're doing, we're going to keep getting what we're getting.
Most people struggle with life balance simply because they haven't paid the price to decide what is really important to them.
We are the creative force of our life, and through our own decisions rather than our conditions, if we carefully learn to do certain things, we can accomplish those goals.
Effective leadership is putting first things first. Effective management is discipline, carrying it out.
The main thing is to keep the main thing the main thing.
The key is not to prioritize what's on your schedule, but to schedule your priorities.

With ICICI it was extremely easy to open a loan, they even opened the office on a Sunday to get it done.
But they are making it extremely hard to close the loan.
Couple of times they send us letters asking us to do outstanding payments when there were no outstanding payments. Then we went to the branch and sorted out and manager gave a letter confirming everything was clear. After an year we get another letter regarding the same payment and again we went to the bank and bank manager apologized when we told we are going to file a case.
Also we saw few other customers there with the same issue while waiting.

Now we trying to close the full loan by paying off everything but the bank says if we pay in advance there is a big penalty.
    These guys are too much.
Iam not sure if this is a proboem with their system or if it is a malpractice, but I would sacrifice service for honesty.

    Salient features of Bill: S.1085

After analyzing this bill, I found the following:

    1. This bill will recapture all those unused employment based visas (gcs) from 1997 till 2008 and it will add those recaptured visas to this year's employment based quota.

    2. After the passage of this bill, any unused visas will rollover to the next year. So, no more wastage of visas as we go forward.

    3. Per country limit will be increased from 7% to 10%, so more folks from over subscribed countries would be able to come under the normal yearly quota.

    4. We will be able to avail the benefits of the recapture after 60 days of the passage of the bill. That means, if they are able to recapture 220,000 (approx) employment based visas, the employment based category will be able to use all those after 60 days of the passage of this bill. USCIS is pre-adjudicating all I485s pending and if this bill gets passed in say for eg by October 30, almost all (80%) in this community (who filed 485) would be able get their GCs in Jan and Feb of 2010.

What makes this bill much more interesting is:

    1. This is not a bill targetting the issues of Employment based category - So there won't be a huge backlash against this in the name of the economy and recession. The provisions for the employment category are just one item in this bill.

    2. Family based immigration reform has a wider range of support from all kinds of groups unlike Employment based immigration reform. Just search for this bill "Reuniting Families Act" in google news and you can identify all those organizations supporting this bill (they all have a news release).

Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.

A career based on lies and deception is criminal in my humble opinion. There are people who actually came to US with valid experience and education, but still end up applying in EB-3 because the employer did not oblige. Sad for them, but it again boils down to the fact that if the job description qualified them for EB-2, then they got cheated. Otherwise, it is just.

I would like to clear the stand that I am a MS holder from an American university and I work as a Sr. Engineer in one of the top internet firms. I left an offer from that crappy operating system maker because that job did not require MS or even BS+5. It was BS+3. I chose a job where I get to apply in EB2.

People who crib about not getting a chance, even though their job description did not support it are wrong, IMO. NO ONE forced you in to that job. This is not slavery and US is not the only place where you can get a job.

Sorry but i dont agree if you call the consultants sleazy or any other thing. Everybody fights to survive here and they are taking a risk at their own cost hence they are benefitting. I donno whether you would not take a eb1 if uscis itself offers u one ? Anyways may be you arent lying but check your company ..all the big companies do creative accounting tell lies to share holders and what not ..does it make them any inferior or superior ..in the end behind every success there are things that are right. So even people who applied in eb2 did somethings right which enabled them to get qualified under it. Dont be a crybaby ..be a man ...u american graduate take risk or show ability to qualify under eb1.

Thanks for the response PASCAL. However I still do not understand why IV is not encouraging everyone to send faxes and register their support via the AILA site. As I have understood AILA has been a leader in this effort for immigration {see July 2007}. If you are trying to say that the interests of AILA and IV are not exactly the same - that is to be expected - no 2 organizations can ever be the same - BUT - surely we can come together to form and pursue some strategic interests. I see that with regard to these bills IV and AILA interests meet. Further if readers @ IV send messages via AILA Action Alert then IV resources can be saved to follow the path that you have described above.

Finally, the bill may be a placeholder or position statement, but in the end we need to demonstrate the numbers - highlighting this bill may eventually lead to some worthwhile convergence in the CIR - I think no opportunity need be lost in this process and the more we highlight our position and condition the more visibility we get.

    Regards!

    Raji

Sorry you do not understand- I really cannot do better right now. Sometimes you just have to accept things! It's not that we do not coordinate or associate with AILA. We do.
The issue here is very specific, both pappu and I have told you what we think and attempted to explain why we do not want to invest resources in a specific action you suggested. Given that I can't spend the hours needed to explain the last few years of work and experience on this issue, I doubt this discussion will go anywhere. Feel free to send the fax. Just accept that we are not going to promote this as a mass action right now for many reasons. Peace!
