Suppose you work for Company A on H-1B. You get out of the U.S. and come back with AP. You become parolee at that time. File an H-1B extension with Employer A, get new I-94 that indicates your status is now H-1B.
6 months later, you get another job with Employer B. Since you already are on H-1B with Company A, you should be able to transfer your H-1B to Company B.
I recently went to South Korea and entered the US on the AP since I didn't feel that I had enough time to wait for my H-1B stamped in my passport at the US emabassy in Seoul. Before leaving the US, I consulted with my attorney on this issue and she assured me that my H-1B is valid as long as I file the extension and maintain terms of the H-1B visa.
This is her opinion in quotes:
"I wanted to emphasize that you do not need to obtain the H visa as long as you have an unexpired Advance Parole document to use instead. To clarify, you are then entering in parolee status but in later filing an H extension or change of employer petition, DHS will terminate the grant of parole and admit you back into H classification. Additionally, if you enter on the advance parole and work consistent with the terms of your underlying current H petition, you are not violating your status nor do you need a separate EAD work card."

there is no difference between online and regular MBA. some universities who have bith , do not even differentiate it in the diploma. for experiance people who add a MBA it has some value if they seek higher position. if you go on to to brick school you could get selected in campus interviews but the position is also lower

I would love to go back to my country i.e India but the problem is there are already tons of people in there and I seriously think they are more brilliant, intelligent and hardworking than me.

:) wait till september, i betting we will see 25-28k eb2 approvals, good for them i guess. it is typical with USCIS, towards the end of the year they wake up and go overtime in approving the cases.
I wonder why USCIS/DOS don't spread the workload across consular posts. During Jul2007 fiasco, most of the I-485 application till Jan'2007 PDs are filed. Now if DOS make the PD for all categories to lets say 2006, they won't recieve any new applications and consular posts could use some numbers.

Based on this poll, anybody with PD of Jun2002 onwards should consider Porting to EB2.
Any thoughts?
It won't help, if everyone starts porting, EB-2 queue will face a similar situation. Porting doesn't happen soon either. With delays in I-140 processing, it may be close to 2 years before you could file for a fresh I-485 with a request to port the EB-3 priority date. Note, this is a grey area and doesn't guarantee you the old PD. If the company is willing to foot the bill, go for it or else IMO it is not worth spending your own money.
Legislative or Administrative fix is our best option. We should focus on the recapture bill and other initiatives by IV, contribute and participate in the action items. We, as a community should raise enough money for lobbying etc.,

Speakers urged the audience, many of whom are undocumented immigrants, to call their elected officials in support of the Kennedy-McCain immigration reform bill. Currently before the Senate, the measure would allow undocumented immigrants to remain in the United States and earn a chance to apply for permanent residency. An alternative bill that already passed the House of Representatives would turn the country�s 11 million undocumented immigrants into criminals, subject to arrest by local authorities. �If you are an undocumented immigrant in the United States, at the moment you have two choices: You can either stay put and hide, or you can lose everything you have,� said Kelly Fincham, executive directors of the newly formed Irish Lobby for Immigration Reform, which organized the meeting at St. Mary�s Help of Christians Catholic Church. Fincham urged those in attendance, even ones who cannot vote, to call or e-mail their U.S. senators and representatives and ask them to vote for the Kennedy-McCain bill. �Do you really want your future to be decided behind closed doors in Washington, or do you want to have a voice?� she asked. An early indicator of the success of her group, formed in December, was the attendance of U.S. Sen. Charles Schumer, who received a standing ovation after addressing the Friday meeting. �If we were to cut off immigration in this country within two, three or four generations, we would become a tired, stagnant, stratified society,� he said. New York �is a special place because of immigration and the worst we could do is close the door,� he added. Other speakers at the meeting urged audience members to sign up and bring their friends to a March 8 bus trip to lobby Congress in Washington, D.C. Groups from cities such as Boston will also be bused in. �This is about living a normal life without fear so you can go and enjoy life in the greatest country on earth,� said Naill O�Doud, chairman of the Irish Lobby for Immigration Reform. Congress is expected to pass sweeping immigration reform legislation later this year affecting America�s estimated 11 million undocumented immigrants, of whom around 40,000 are Irish. One version, which already passed the House of Representatives, is an �enforcement only� bill sponsored by Representatives James Sensenbrenner (R-Wis.) and Peter King (R-N.Y.). Known as the Border Protection, Antiterrorism, and Illegal Immigration Control Act, the measure makes it harder for legal permanent residents to become U.S. citizens by allowing government officials to deny naturalization applications based on subjective information or secret evidence. The measure intensifies sanctions against employers who hire undocumented immigrants and requires them to confirm the authenticity of their workers� Social Security numbers. It gives local police the power to enforce immigration laws and penalizes states and cities that protect confidentiality of immigrant crime victims and witnesses. Other provisions would make drunken driving a deportable offense and mandate the construction of five double-layer border fences at a cost of $3.2 million per mile. The Kennedy-McCain bill, known as the Secure America and Orderly Immigration Act, was introduced before the Senate last year by Senators Edward Kennedy (D-Mass.) and John McCain (R-Ariz.). The measure would permit undocumented or �illegal� immigrants currently living in America to obtain work visas for up to six years. They could apply for permanent residency after paying fines, passing a background check and completing a period under a temporary visa. I don't know why but we tend to be satisfied with lsmall benefits...
I agree with you "something (EAD and AP) is better than nothing"
But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..
What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.
I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.
After you apply for AP its only 1 year H1 increments.
What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.
We had a small revolt (peaceful way) and its successful.We dont want to stop there.
